1. Acceptance of Terms
By accessing or using Launch.now ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform. These Terms apply to all visitors, users, and others who access or use the Platform.
2. Description of Service
Launch.now provides a SaaS boilerplate platform that includes authentication, billing, team management, and collaboration tools. We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time with reasonable notice.
3. Account Registration
You must create an account to access certain features. You agree to provide accurate, current, and complete information during registration and keep your account information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
4. Subscriptions and Billing
Certain features require a paid subscription. Fees are billed in advance on a monthly or annual basis as selected during checkout. All fees are non-refundable except as expressly stated in our refund policy. We may change our fees with 30 days' notice. Continued use after a fee change constitutes acceptance of the new fees.
5. Acceptable Use
You agree not to use the Platform for any unlawful purpose or in violation of any applicable laws. You may not: (a) attempt to gain unauthorized access to the Platform or its systems; (b) use the Platform to transmit malware or harmful code; (c) interfere with the operation of the Platform; (d) scrape or harvest data without permission; (e) impersonate any person or entity.
6. Intellectual Property
The Platform and its original content, features, and functionality are owned by Launch.now and are protected by international copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Platform in accordance with these Terms.
7. User Content
You retain ownership of any data, content, or materials you submit to the Platform. By submitting content, you grant us a worldwide, royalty-free license to host, store, and process your content solely to provide the Platform services. You represent that your content does not violate any third-party rights.
8. Data Protection and Privacy
Our collection and use of personal data is governed by our Privacy Policy. We implement reasonable technical and organizational measures to protect your data. As a data processor, we will process your data in accordance with your instructions and applicable data protection laws.
9. Limitation of Liability
To the maximum extent permitted by law, Launch.now shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Platform. Our total liability for any claim arising from these Terms shall not exceed the amount you have paid us in the 12 months preceding the claim.
10. Termination
We may terminate or suspend your account at any time for violation of these Terms. Upon termination, your right to use the Platform will immediately cease. You may terminate your account at any time by contacting us. Provisions regarding intellectual property, limitation of liability, and dispute resolution shall survive termination.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Platform. Your continued use of the Platform after changes become effective constitutes acceptance of the new Terms.
12. Governing Law
These Terms shall be governed by the laws of France, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Paris, France.
